4. PRIVACY
- All of the terms and conditions of the KPOP1004 Privacy Policy (as defined above), which shall govern all Users of the Website.
5. PURCHASE OF PRODUCTS; ROM AMERICA ACCOUNTS.
- Registration of an KPOP1004 Account. You may access most areas of the Website and purchase goods or services offered for sale by KPOP1004 to you, including but not limited to through the Website (the “Products”), without registering an account with us, but certain areas and features of the Website will only be available to you if you register for an account (an “KPOP1004 Account”). Every effort is made to instruct our food production staff on the severity of food allergies. In addition, we label items with possible allergen-containing ingredients; however, there is always a risk of contamination. There is also a possibility that manufacturers of the commercial foods we use could change the formulation at any time, without notice. Customers concerned with food allergies need to be aware of this risk.
Please be aware that our facility prepares foods and uses ingredients in our products that contain nuts or nut oil. If you have any type of food allergy, please refrain from eating our products.
Food Allergies involve the immune system. A protein within a food, known as the allergen, triggers a reaction from the immune system. The body tries to protect itself from the allergen by producing antibodies. These antibodies cause the body to release chemicals, which produces an allergic reaction. It is estimated that 10% of the U.S. adult population has a food allergy.

We may terminate this Agreement or terminate or suspend your access to the Website ( or any portion, aspect or feature of thereof, including without limitation closing or deleting your ROM AMERICA Account of an ROM AMERICA Purchaser and anycontent or information that you have posted in such ROM AMERICA Account) , and/or prohibiting you from using or accessing the Website (including without limitation prohibiting any further purchases of any Products through the Website) for any reason (including without limitation your breach of this Agreement or the ROM AMERICA Privacy Policy), or for no reason, at any time in our sole discretion, with or without notice to you, effective immediately, which may result in the forfeiture and destruction of all information or other content associated with you and your activities in connection with the Website.In the event of termination for any reason you will still be bound by your obligations under these Agreement, including the representations and warranties made by you, and by the disclaimers and limitations of liability. Additionally, we will not be liable to you or any third party for any termination of your access to the Website.
